Terms and Conditions

This Agreement sets out the terms and conditions relating to the online content provided free of charge and content subject to payment (“Free and Paid-for Content”) that Olive Tree Media (“the Siteowner”) will provide to you (“the User”).

 

Please read these carefully before proceeding to use the services provided. The Siteowner reserves the right to update and edit the Terms of service without any prior notice.

 

1. Account terms

By accessing www.olivetreemediautah.org  (“the Site”) the User is agreeing to the terms and conditions below. If the User uses the Site in the course of business the User is also agreeing to these terms and conditions on behalf of that business. If the User does not agree with the terms and conditions (or the User is not authorized to do so) the User should not use the Site.

 

2. Payment and access

A valid credit or debit card or Paypal account is needed to make payments. Financial information is not required to create or use a free account.

For three month (Quarter) subscriptions, Olive Tree Media will charge one time and you will have access for 3 months. Three month subscriptions do not auto-renew and you will not need to cancel. There will be no refunds or credits, nor refunds made should you not use the membership during a period of time when your account is open.

For annual subscriptions, Olive Tree Media will charge one time and you will have access for 12 months. Annual subscriptions do not auto-renew and you will not need to cancel. There will be no refunds or credits, nor refunds made should you not use the membership during a period of time when your account is open.

Should you change your type of membership, your credit card will be charged the new billing amount immediately.

All fees are exclusive of all taxes or duties imposed by governing authorities. You have sole responsibility for paying all such taxes or duties.

We have four different membership levels on our website. Your membership payment gives you access only to the membership level you signed up for. You cannot have more than one active subscription at a time. When you upgrade or add a plan, the older plan will automatically cancel.

Our annual subscriptions will give you access only for the year that you are subscribed. For example, if you subscribe in May 2025, you will have access to the lesson packets starting from May 2025-May 2026. You will not have access to previous year's materials, but they are available in our store if you wish to purchase them individually.  For 3 month subscriptions, you will have access to the packets that are on the website for 3 months. For example, if you subscribe in May 2024, you will have access to the lesson packets starting from May 2024-July 2024. We post one month in advance. We only keep 3 months of packets posted at a time, so we do encourage you to download the packets to your computer. Relief Society is slightly different - you will have access to the most recent General Conference lesson packets, plus the previous General Conference. We provide 23 lesson packets for each General Conference and will post them within 2 months from the General Conference Session.

 

3. Access

If the User wishes to access the Paid-for Content the User will be asked to provide the Siteowner with accurate, complete registration information, including contact details, and it is the User’s responsibility to update and maintain this information. The Siteowner is entitled to rely on this information to provide Paid-for Content. The User will also be requested to create a Password in a format specified by the Siteowner (“the Password”). The User shall not disclose the Password to any other person or entity and shall ensure that the Password remains confidential at all times. If you subscribe to The Calling Plan, you do have permission to share your password with those in your organization/presidency within your Church calling. Please do not share your login information beyond that.

 

A contract with the User for a Paid-for Content will come into effect when the Username and Password are issued to the User.

 

4. Modifications to the Service and Fees

In the event of an unauthorized payment the Siteowner reserves the right to suspend or terminate the User’s access to the Site and Paid-for Content. If no payment authorization is received or payment authorization is subsequently cancelled, the Siteowner may immediately terminate or suspend access to any Paid-for Content and/or the Site. The Siteowner will try to process the User’s request for any Paid-for Content promptly but does not guarantee that the Paid-for Content will be available to the User by any specified time.

 

5. Cancellation and Termination

All memberships do not auto-renew, so you do not need to worry about canceling them. All memberships require a one-time membership subscription fee. There will be no refunds or credits, nor refunds made should you not use the membership during a period of time when your account is open.

You may cancel your account at any time by clicking on the My Account link on the Home page. The My Account section provides a straightforward link to cancel your account under Manage Subscriptions. Email or phone requests to cancel your account will not be deemed canceled. If you do not receive an emailed cancellation receipt, you did NOT cancel correctly. 

Olive Tree Media reserves the right to temporarily or permanently edit, suspend, or terminate your account at any time for any reason with prior notice. Olive Tree Media also reserves the right to delete all Content associated with your account. Olive Tree Media may refuse Service to any physical or juridical entity for any reason at any time.

 

6. Refunds

Because of the nature of the digital products, Olive Tree Media does not offer refunds on memberships or any other digital products that are purchased.

If you subscribe to an annual membership, you will have access for 12 full months. If you cancel within those 12 months, no refund is given, but you will still have access to your membership for the full 12 months. You can switch your annual subscription plan to a different level of membership at any time by sending an email to [email protected].

 

7. Copyright and Intellectual Ownership

Olive Tree Media, its affiliates or its suppliers own the Intellectual Property rights to any and all protectable components of the Service, including but not limited to the name of the Service, graphic materials, artwork, printables, downloads, PDFs, JPG files, etc.

You may not copy, edit, adapt, reproduce, distribute, any aspect of the Service which Olive Tree Media, its affiliates or its suppliers own. If you’d like to edit a product on Olive Tree Media into a different language, you will need to get prior written consent from Olive Tree Media. You also agree and undertake to not use robots, spiders, other automated devices, or manual processes to control or copy any content of the Service.

8. Privacy and Data Protection

The use of the Site signifies the User’s consent to the Siteowner collecting and using personal information about the User in accordance with the Siteowner’s Privacy Policy. The User can read the Privacy Policy here.

 

9. General Conditions

You understand and agree that the Service is provided "as is" and "as available".  The Siteowner will try to process the User’s request for any Paid-for Content promptly but does not guarantee that the Paid-for Content will be available to the User by any specified time.

 

Olive Tree Media makes no guarantees regarding (a) your ability to use the membership, (b) your satisfaction with the membership, (c) that the membership will be available at all times, uninterrupted, and error-free.
